OSHA Penalty Reminder for 2020

Former President Barack Obama signed the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 in an effort to “improve the effectiveness of civil monetary penalties and maintain their deterrent effect,” according to a memorandum posted through OSHA’s Principal Deputy Assistant Secretary Loren Sweatt.

The memorandum, released earlier this month, outlines Federal OSHA's updated maximum civil penalty amounts for 2020 based on the annual adjustment for inflation. The Inflation Adjustment Act requires such increases be made no later than January 15 of each year. The maximum penalty amounts for 2020 are as follows:

  • Serious or Other-than-Serious: $13,494
  • Willful or Repeat: $134,937
  • Per Day Failure to Abate (limited to 30 days maximum): $13,494
